Minister of Justice wants to pay more attention to legislative drafting and crime prevention

Today Mr. Rein Lang, the Minister of Justice, introduced the plans of the Ministry of Justice for the years 2005-2007, emphasising the issues of legislative drafting and penal policy the most.

As for legislative drafting the Minister pointed out that the Commercial Code, which has helped to make Estonia one of the most favourable business environments in Europe, will celebrate its 10th anniversary this autumn. "The Commercial Code has functioned well, but my goal is to make Estonia's business environment even more flexible and mobile," said the Minister of Justice.

The Minister also wants to complete the reform of private law in Estonia. To that end it is planned to have the Government approve and submit to the Riigikogu the new draft Family Law Act and amendments to the Law of Succession Act even before the summer holiday.

In the field of public law it is planned to revise the State Secrets Act, the Public Information Act and the Personal Data Protection Act in order to organise the definitions of protected information, limited access information and public information as well as their regulation.

According to the Minister of Justice there is an agreement with the Minister of the Interior regarding drafting a law enforcement act. "This draft act will be drawn up by a 5-member work group comprising representatives of law enforcement agencies and local authorities and the draft will be submitted to the Government by August 1," assured the Minister of Justice.

In the field of penal policy the Minister of Justice aims at reducing the number of prisoners and prisons and increasing the proportion of alternative punishments: "A prison does not make anyone better and thus, the imprisonment of a person is the last resort. We should take more advantage of our well-functioning probation supervision system and alternative punishments. With our 4,600 prisoners we hold the top place in Europe and have nothing to brag about – it would be wise if we could after a while bring this figure down to 3,000-3,500 through various measures."
